Folks, as part of your membership fee, we propose to provide Club Insurance through MCC. Without this insurance, it would be extremely difficult to conduct club events because of liability concerns. This is of HUGE benefit to those of us who ride off-road, as it protects club members over and above your regular motorcycle insurance for situations described below where your insurance may be lacking. The insurance is not a license to trespass, it's just coverage that could open a door for a private landowner to give permission to be on their land for club events, whereas without this insurance, they may not even entertain a request to be on their land.

FAQ’s (Frequently Asked Questions)

NOTE: This document has been created to answer general questions about the MCC Insurance program. The actual policy document should always be referred to for precise answers. Contact the MCC or Jones Brown Motorsports.

Insurance General

Q – What does this policy cover?

A - This is a Third-party Liability Policy. It covers claims made by a third-party for bodily injury, personal injury or property damage that might occur during the normal business and social activities of a club or association. Liquor Liability insurance is included unless you are controlling the sale and service of liquor yourselves, in which case we require an additional “Liquor Liability” policy. Contact Kevin Besta at Jones Brown Motorsports at 888-379-6821 for information.

Q – What is NOT covered?

A – Generally, there is no coverage for property that the insured (you) owns, rents or leases (you need Property Insurance for that). There is no Accidental Death & Dismemberment coverage. Competitive events are not covered (except for Observed Trials in specific circumstances). This means road races, motocross, enduros, trials, etc. There are a few exceptions stated later in this document. For more information, contact MCC or Kevin Besta at Jones Brown.

Q – Who is covered?

A - The MCC, its member associations and clubs, the individual members, participants and spectators PROVIDED that the organization holding the activity has opted in and paid its share of the premium.

Q - Is any kind of competition covered?

A - Generally, no. Some exceptions would be demonstration contests such as slow rides, manoeuvring, etc. Non-sanctioned trials, when held in the club with only members participating by a club which does not hold other competitive events, are covered. Contact MCC or Kevin Besta at Jones Brown Motorsports at 888-379-6821 for clarification.

Q – How can we cover our competitive events?

A - Contact either the MCC or Jones Brown for a referral to a sanctioning body that provides insurance.

Q – Where does this policy end and an individual member’s vehicle policy kick in?

A - The individual member’s policy is always primary.

Q - Does this differ by jurisdiction?

A - No

Q - Does this replace Director & Officer Insurance?

A – The MCC policy covers the Directors, Officers and members for third-party liability claims as described above. “Director & Officer Liability Insurance” is a specific type of insurance dealing with fiduciary issues - payroll, tax remittances and so forth – and may or may not be required by your organization.

Q – What other insurance coverage might we need?

A – Depending upon your scope and size, you may want to consider Property Insurance, Director & Officer Liability Insurance, Errors and Omissions Insurance, Personal Accident Insurance or Liquor Liability Insurance.

Q – Can we get that through MCC/Jones Brown?

A – Yes, simply contact us.

Q – When do I need a “Certificate?”

A- If a third-party (e.g. someone you rent space from) asks for it.

Q – What will I receive from MCC that shows my coverage?

A – You will receive a copy of the Certificate of Insurance as soon as you sign on to the program. A copy of the full policy is available upon request.

Our club

Q – Our group is not incorporated. Can we be insured?

A – MCC STRONGLY RECOMMENDS that clubs and associations be incorporated. The protection offered far outweighs the costs and effort for annual reporting. Regardless, the MCC program covers the members provided that your club is organized and has members and opts in to the program.

Q – Our club has participants at our events who are not members. Are they covered?

A – Yes, they are covered. The premium remains the same. There is no additional premium for non-member participants. See the “Rates” section.

Q – If we join the program part way through the year, what are our premiums?

A - Generally, given the extremely low cost of this insurance, there is no pro-rating. Exceptional circumstances will be dealt with on a case-by-case basis.

Q – What information does my club need to provide MCC? How often?

A – First, you must apply for inclusion, and an invoice will be prepared. The coverage will start as soon as payment is received. The premium is based on number of members you declare. You will be asked MONTHLY to confirm any increases to membership, and remit immediately. This will be a simple procedure.

Our activities

Q – Our club organizes trail rides. These rides are on public and/or private lands. They are not timed. Are these covered?

A – Yes, but see the “Geography” section.

Q – Our club publishes a magazine. We have an editor, and accept paid advertising. Is this activity covered?

A – Yes, and no. If your magazine goes only to members, it will be covered. If it is distributed commercially, you will require additional media insurance.

Q – What about our newsletters and our website. Are these covered?

A – These are covered as internal, regular business activities of your organization.

Q – Does this cover the club and its members when we rent a hall for meetings or events?

A - Yes

Q – Our club is doing a “Show-and-Shine” display in the parking lot of a local mall. The Property Management has asked for a certificate and to e a “Named Insured”. What do we do?

A – Call and we will arrange for the certificate. There is no charge.

Q- What if they want a higher liability limit that the $2,000,000 in the MCC program?

A – Increases in limits are available for a small fee. Contact us.

Q – Our club offers motorcycle rider training. Is that covered?

A – Yes, and no. If you are operating occasional skills improvement days, they will be covered. Alternatively, if you operate a school, publish a schedule, solicit and train new riders, that is NOT covered.

Q – Our club does substantial preparation for events (e.g. trail preparation). Is that covered, even if the event will be competitive?

A – Yes, it is covered, although the actual competitive event is not.

Q - Our club does a dinner dance event, and alcohol is served. What is our coverage?

A- The MCC master insurance policy extends to include all social activities as long as the alcohol license and alcohol service is provided through a third-party. If the club holds the liquor permit and/or serves the alcohol, additional insurance is required. Please contact Kevin Besta at Jones Brown Motorsports at 888-379-6821 for information.

Q - Are spectators and/or visitors covered?

A - Yes

Q – Are skills demonstrations – such as “slow riding, manoeuvring, balance” – covered? What if there is a contest? What about “Observed Trials” competitions?

A – These are covered. However, if the “contest” is a speed (fastest) or wheel-to-wheel event it is a competition, and not covered. Clubs that operate only non-sanctioned, intra-club (within the club) trials for members will be covered.

Q – What about Charity Rides?

A – If your club is doing a Poker Run or Toy run, as part of its regular activities, it is covered by this policy. Standalone Charity Rides require different coverage. Please contact the MCC.

Geography

Q – We are organizing an event to be held in the USA. Are we covered?

A – No. By law, we cannot insure events held in the US.

Q - Our club is doing a ride, part of which will be in the USA. Are we covered?

A- Yes, but your vehicle policy is primary.

Q – Is the coverage valid anywhere in Canada, even if our club is just local?

A – Yes

Q – We are doing a joint event with a club from another province. Are we covered outside of our home province? Is the event covered if it’s outside of our home province?

A- Yes.

Rates

Q - What is the cost of coverage?

A – The actual cost will be determined based on your “Application for Inclusion” form submitted to MCC, as well as any changes through the year. Generally, the cost is $3.00 per member (plus the entity (club)(if incorporated) as one “member”) per policy term. GST is included. There is no charge for limited non-member participants (club demo days), but membership is STRONGLY encouraged.

Rates are subject to change at the time of renewal. A minimum fee of $75 plus GST applies. Check with MCC.

Q – What is the policy term?

A – The MCC program provides coverage from November 1 to October 31. There is no pro-rating. Exceptional circumstances will be dealt with on a case-by-case basis.

Operations Annual club liability including social, business and non-competitive activities. Does not include wheel-to-wheel /racing events or activities.

o Any personal or organization engaged in operating, managing, sanctioning or sponsoring the covered program or providing the premise for a covered program including officials of the covered program are included as additional insureds.
o Any participant, competition vehicle owner and competition vehicle sponsor are included as additional insured
o Volunteers are included as additional insured
o Medical professionals added as additional insureds, subject to $300,000 limit of liability per occurrence/per aggregate.
o Errors and Omissions, event only, subject to $50,000 limit of liability per occurrence/per aggregate $2,500 deductible
o Participant property damage legal expenses, subject to a limit of liability of $100,000 per occurrence/per aggregate, $2,500 deductible.

Exclusions
o Events or activities not schedules or not usual to your business
o Fireworks and concerts
o Amusement devices (mechanically operated)
o Intended or expected injury to others
o Any obligation of the insured for a workers compensation, disability benefits or unemployment compensation law or similar law
o Bodily injury to an employee of the insured arising out of and in the course of employment of the insured
o Employment related practices, sexual harassment and discrimination
o Bodily injury to any person in a restricted area from whom you have not obtained a valid waiver and release and waiver unless by inadvertent error
o Bodily injury or property damage arising out of the ownership, use or operation by or on behalf of the insured of any automobile other than competition vehicles or official vehicles during a covered program while on the premises
o Watercraft, Aircraft, Air cushion vehicles
o Property damage to property you own, property you sell or give away, property in your care, custody and control
o Property damage to property owned, leased to, rented to or used by any participant or employee when in the restricted area
o Limited pollution
o Nuclear liability, war and terrorism, asbestos
o Noise exclusion
